RULES FOR BUYING AND SELLING GOODS, GIFT CARDS, COUPONS OF THE ELECTRONIC STORE GROZIO.LT

 

  1. Concepts

1.1. Seller – UAB “Grozio Galia”, company code: 303326876, VAT payer code: LT100008893815, registered office address/address for correspondence: Vilnius, Vasario 16-sios g 2 -119, LT -01106.

1.2. Grozio.lt is an electronic store at www.Grozio.lt.

1.3. Buyer – 1) an individual person who can enter into transactions in accordance with valid legal acts, who buys goods for personal use (not for business purposes), 2) a legal entity of the Republic of Lithuania who buys goods as an end user (intending to use the goods for representational or other purposes not related to resale of goods or their use for business, production, service provision purposes; 3) properly authorized representatives of all the above-mentioned persons.

1.4. Parties – Buyer and Seller together.

1.5. Seller’s partner – a legal entity: 1) used to fulfill the Buyer’s order; 2) Grozio.lt, with which joint actions or projects are carried out, is published on the websites of this legal entity or in any media where the action or project of Grozio.lt and this legal entity will be described.

1.6. Personal data – any information related to a natural person – a data subject whose identity is known or can be directly or indirectly determined using data such as a personal code, one or more physical, physiological, psychological, economic, cultural or social characteristics characteristic of a person signs

1.7. The rules are the following “Rules for the purchase and sale of Grozio.lt electronic store goods, gift cards, coupons”.

1.8. Account – the result of the Buyer’s registration on Grozio.lt, which creates an account that protects his personal data and order history.

1.9. A product is everything that is sold in the online store Grozio.lt: cosmetics and perfumery, accessories, home decoration products, gift and loyalty cards and coupons. The terms “good” and “goods” used separately in the Rules mean both singular and plural.

1.10. Privacy policy – ​​a document approved by the Seller, which provides the basic rules for the collection, storage, processing and storage of Personal data using Grozio.lt. The Privacy Policy is an integral part of the Rules.

 

  1. General provisions

2.1. These Rules are a binding legal document for the Parties, which determine the rights and obligations of the Parties, the conditions for purchasing and paying for goods, the procedure for the delivery and return of goods, and other conditions related to the purchase and sale of goods on Grozio.lt.

2.2. The seller reserves the right to change, supplement, or amend the Rules at any time. The new version of the Rules enters into force after its publication on Grozio.lt. Registered Buyers, who have agreed to receive website notifications, are informed of changes to the rules by e-mail. The Buyers have the opportunity to familiarize themselves with the valid version of the Rules on the Grozio.lt website, and are also introduced each time during the purchase of Goods.

2.3. All persons specified in p. 1.3 of these Rules have the right to register and buy goods on Grozio.lt, having confirmed that they are familiar with the Rules (clause 2.4 of the Rules). Buyers, confirming familiarity with the Rules, at the same time confirm that they have the right to buy goods on Grozio.lt, i.e. corresponds to the concept of Buyer specified in the Rules.

2.4. The buyer gives his familiarity with the Rules and his consent to comply with them by ticking the box next to the statement: “I have familiarized myself with the rules for buying and selling goods, gift cards, coupons of the electronic store Grozio.lt and I AGREE WITH THEM”. The Buyer has the option to agree or disagree with the statement specified in this clause of the Rules when registering in the online store Grozio.lt by filling out the “Registration of new customers” form, as well as every time placing an order for the purchase of goods.

2.5. If the Seller has the right or obligation to provide the Buyer with information or documents by e-mail, in all cases, the Buyer is responsible for providing the Seller with a working e-mail address belonging to the Buyer.

 

  1. Protection of personal data

3.1. When purchasing goods, the Buyer must provide the Seller with personal data necessary for proper delivery of the goods: name, surname, address (city, street, house number (apartment number – optional), postal code) for the delivery of the goods, active e-mail address address and phone number for contact regarding order confirmation (if necessary) and/or obtaining data required to make payment for the goods. Registered Buyers, when filling out the registration form to create an Account, save the password in the Seller’s system that they want to use for subsequent logins to the Account created during registration.

3.3. By agreeing to these Rules, the buyer agrees that the e-mail specified by him informational messages necessary for the order, payment and delivery confirmation of goods or other order execution would be sent to the email address.

3.4. The Seller ensures that the Personal Data of the Buyers specified in Clause 4.2 of the Rules will be used only for the purpose of selling goods. With the Buyer’s separate consent, the data provided by the Buyer will also be used for direct marketing purposes.

3.5. Personal data of Buyers collected by the Seller for direct marketing purposes are stored for no longer than 2 years from the last time the Buyer logged in to his Account or the last action of the Buyer (submission of an order, purchase of a product) on Grozio.lt.

3.6. The Seller does not collect Buyers’ data related to their payment information. All payments are made through partner channels (Paysera.com, Venipak.lt).

3.7. The Seller undertakes not to disclose the Buyer’s personal data to third parties, with the exception of the Seller’s partners providing goods delivery or other services related to the proper fulfillment of the Buyer’s order. In other cases, the Buyer’s personal data may be disclosed to third parties only in accordance with the procedure provided by the legal acts of the Republic of Lithuania.

3.8. Taking into account 3.6. and p. 3.7, by agreeing to these rules, the Buyer also declares that he agrees that UAB “Grozio Galia” will process the Buyer’s personal data provided by the Buyer himself or received by the Seller during the execution of the Agreement and provide it to partners for the purpose of executing the Agreement (delivery of goods, ensuring settlement, etc. .) to the extent necessary to fulfill the respective functions. The buyer is informed that the list of data recipients may change. The Buyer is informed that he has the right to contact the Seller (personal data processor) with a request to provide a list of entities to which his personal data has been transferred.

3.9. The seller can approve a separate document – the Privacy Policy, which is intended to regulate the basic rules for the collection, storage, processing and storage of Personal data, using Grozio.lt. In such a case, the approval of the Privacy Policy will be considered a change to these Rules, which shall enter into force in accordance with the procedure set forth in these Rules. The approved Privacy Policy will be an integral part of the Rules, therefore the term “Rules” will also include the Privacy Policy.

 

  1. Ordering goods, concluding a purchase and sale agreement

4.1. Registered and unregistered users can shop in the online store Grozio.lt.

4.2. The legal relationship of purchase and sale between the Seller and the Buyer arises and the purchase and sale agreement (hereinafter – the Agreement) between them is considered concluded from the moment when the Buyer, having chosen the purchased item(s) in the Grozio.lt electronic store and formed the goods shopping cart, completes all the steps of the order (including familiarization with these Rules and confirmation of this in the appropriate fields), the last of which is the selection of the payment method, and clicks the “Confirm order” link.

4.4. Buyers’ orders are registered and stored for no longer than 2 (two) years in the Grozio.lt e-store database, counting from the end of the last purchase-sale relationship. In the event that the Seller deems it necessary, Buyers’ orders or even a specific order of an individual Buyer can be stored in the Grozio.lt e-store database for a longer period of time, if this is necessary for the Seller’s accounting and/or to implement other legitimate purposes of the Seller related to his activities.

 

  1. Buyer’s rights

5.1. The buyer has the right to purchase goods in the online store Grozio.lt in accordance with the procedure set forth in these rules.

5.2. The buyer has the right to refuse the order in accordance with the procedure established by these Rules.

5.3. The buyer, following the procedure specified in point 12 of the Rules, has the right to cancel the Agreement concluded online with Grozio.lt, but no later than within 14 (fourteen) days from the day of delivery of the goods.

5.4. The buyer has the right to exchange or return the purchased goods in accordance with the procedure established by these Rules.

5.5. The buyer has other rights provided for in these Rules, the Privacy Policy, and the legal acts of the Republic of Lithuania.

 

  1. Seller’s Rights

6.1. The seller has the right to change, suspend or terminate the operation of certain functions of Grozio.lt or part of them, as well as to change the arrangement of elements on Grozio.lt.

6.2. The seller has the right to suspend or terminate the operation of Grozio.lt. In this case, all accepted and confirmed orders of Buyers are completed and new orders are not accepted.

6.3. The Seller has the right to cancel the Buyer’s order according to p. 10 of the Rules. under the stipulated conditions and procedure.

6.4. When the Buyer chooses the payment method provided for in clause 9.3.3 of the Rules or clause 11.4. intended delivery method, the Seller, in the event of uncertainty regarding the information provided in the order, has the right to contact the Buyer using the contacts specified in the order.

6.5. The Seller can carry out various types of marketing promotions and, with the prior consent of the Buyers, inform them about these promotions by sending information to the contacts specified by the Buyers. The seller also has the right to change the conditions of the marketing promotions in question at any time unilaterally, without separate notice, and to terminate promotions that have already started.

6.6. The seller has other rights provided for in these Rules or legal acts of the Republic of Lithuania.

 

  1. Obligations of the buyer

7.1. The buyer must pay for the purchased goods on time and accept them in accordance with the procedure set forth in these Rules. Having chosen to collect the goods in one of the showrooms of UAB “Grozio Galia”, the Buyer must collect them in the selected showroom within the terms specified in the Rules.

7.2. The buyer undertakes to protect and not transfer to third parties his login data to the online store Grozio.lt. The responsibility for the consequences arising from improperly stored login data rests with the Buyer.

7.3. Buyers of Grozio.lt e-shop must familiarize themselves with these Rules and UAB “Grozio Galia” Privacy Policy, as well as comply with them and other conditions clearly indicated in the e-shop, and not to violate the laws of the Republic of Lithuania.

 

  1. Obligations of the seller

8.1. The seller undertakes to make it possible to use the services of the electronic store, the operating conditions of which are determined by these Rules and other conditions provided by Grozio.lt.

8.2. The Seller undertakes to deliver the goods purchased by the Buyer to the specified address in accordance with these Rules.

8.3. The Seller undertakes to respect the Buyer’s privacy right to his personal information, i.e. Personal data of the Buyer shall be processed only in accordance with the Rules, Privacy Policy and legal acts of the Republic of Lithuania.

8.4. Under the conditions stipulated in the rules, the Seller undertakes to provide the goods ordered by the Buyer and to accept the goods returned by the Buyer.

8.5. In the event of unforeseen circumstances, when due to unforeseen circumstances the Seller is unable to deliver the goods purchased from the online store Grozio.lt, the Seller undertakes to offer the Buyer an analogous or similar product as far as possible. If the Buyer refuses to accept the Seller’s offered product as analogous or as a similar product, the Seller undertakes to return the money paid to the Buyer within 9 (nine) working days from the receipt of the Buyer’s refusal, if the advance payment was made, and if the payment was not made – to cancel the order.

8.6. When the buyer returns the goods, the Seller undertakes to return the money paid by the buyer within 9 (nine) working days from the day of returning the goods to the Seller.

 

  1. Prices of goods, terms and procedure of payment for goods

9.1. The prices of goods in the online store Grozio.lt are indicated in euros with VAT.

9.2. The price of the goods cannot change after the Seller has confirmed the order, except in cases where the price of the goods has changed due to a technical error in the information systems or other objective reasons beyond the Seller’s control. If in this case the Buyer does not agree to purchase the product at a new price, the Buyer may cancel the order by informing the Seller about this within 2 (two) working days. Upon cancellation of the order in accordance with the procedure provided for in this point, all amounts paid by the Buyer are returned to the Buyer.

9.3. The buyer pays for the purchased goods in one of the following ways:

9.3.1. electronic banking, payment partner – paysera.lt (payment is made at the time of ordering);

9.3.2. by bank transfer (payment is expected in 3 working days);

9.3.3. in cash, paying it to the courier who delivered the goods (settled at the time of delivery). If the product fails to be delivered 2 or more times due to circumstances beyond the courier’s control and the order is canceled as a result, Grozio.lt may limit the option of paying the courier to a specific buyer or require advance payment.

 

  1. Cancellation of order

10.1. The Seller has the right to cancel the Buyer’s order without prior warning, if the Buyer, having chosen the payment methods provided for in clauses 9.3.1 or 9.3.2 of the Rules, does not pay for the goods within 3 (three) working days.

10.2. In the event that the Buyer’s advance payment for the ordered goods has been made, but the Buyer cannot be contacted for 3 (three) working days during the delivery of the order, the Seller has the right to unilaterally cancel the order without separate notice, and to refund the goods to the Buyer within 9 (nine) working days money paid; in this case, the Seller has the right to deduct and not refund the Goods delivery fee.

10.3. If the Buyer has confirmed the order according to p. 4.2 of the Rules. or 4.3 p. according to the established procedure, but later decided to cancel the order for any reason, regardless of whether the advance payment has already been made or not, he has the right to cancel the order within 24 hours of the order by submitting a notification to the Seller by e-mail. by mail at: [email protected]. After receiving the specified notice from the Buyer, the Seller will no longer execute the Buyer’s order and cancel it, and if the Buyer’s payment has been made, within 9 (nine) working days, the Seller will return the money paid to the Buyer. In the event that the Buyer submits a refusal after missing the 24-hour deadline, the money for the goods is also returned, but other negative consequences arising from this are borne by the Buyer.

10.4. In the case provided for in Clause 6.4 of the Rules, the Seller has the right to cancel the Buyer’s order without prior notice, i) if the Seller fails to contact the Buyer 2 (two) working days after placing the order, or ii) if the Buyer does not provide the Seller with the requested information by the deadline specified by the Seller, or iii) if the Buyer does not give consent to the Seller for checking his personal data.

10.5. The Seller has the right not to confirm the order or to cancel it at any time before its delivery/handover to the Buyer, as well as to decide not to sell goods to the Buyer in the future, if there is a reason to conclude that the Buyer does not meet the definition of Buyer defined in these Rules, namely that the goods are not purchased for personal use (final for consumption) needs, but for business (for resale, use of goods for providing services or purchasing other goods, etc.). In case of doubt, the Seller may contact the Buyer for additional confirmation regarding the Buyer’s status.

 

  1. Delivery and collection of goods

11.1. The Buyer has the right to pick up the goods himself or through a specified representative, upon arrival at one of the “Grozio Galia” showrooms owned by the Seller (the specific showroom where the collection of goods is available is selected during the creation of the Goods order from the list provided), or choose the goods delivery service; by choosing the latter option, the Buyer undertakes to provide the Seller with the exact delivery address of the goods.

11.2 The buyer undertakes to pick up or accept the goods himself or to designate another recipient of the parcel.

11.3. The Seller or his authorized representative can deliver the goods to the Buyer or the person designated by him.

11.4. If the Buyer chooses a courier service during the order:

11.4.1. The buyer undertakes to indicate the exact place of delivery of the goods.

11.4.2. The buyer undertakes to accept the goods himself. When accepting goods, it is necessary to present a valid personal identification document (identity card, passport or new model driver’s license). If the Buyer cannot accept the goods himself, and the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims to the Seller regarding the transfer of the goods to the wrong person.

11.4.3. The Seller or his authorized representative can deliver the goods to the Buyer or the person designated by him.

11.5. The buyer can collect the goods free of charge at one of the Goods collection centers. If the Buyer chooses the following method when placing an order:

11.5.1. The ordered goods must be collected no later than within 3 (three) working days after the Seller informed the Buyer by phone and e-mail that the goods can be collected.

11.5.2. The goods can only be collected by the person who placed the order or the person indicated at the time of placing the order. When picking up the goods, it is necessary to have with you and present to the Seller’s employee a valid identity document (identity card, passport or new driver’s license).

 

11.6. For delivery in Lithuania, a fee of EUR 2.95 is charged when the goods are delivered to the address chosen by the Buyer. If the amount of the Buyer’s order (after all discounts due to him) corresponds to the amount of the basket clearly published in the online store (14.99 EUR), from which delivery is free – the delivery price is 0 EUR.

11.7. The seller reserves the right to change the delivery fee and the amount of the purchase, from which delivery is free. Valid rates are indicated in the order creation window so that the Buyer has the opportunity to get acquainted with them before confirming the order.

11.8. The buyer undertakes to compensate UAB “Grozio Galia” for the costs incurred by UAB “Grozio Galia” courier services in the event that it is not possible to deliver the goods to him due to circumstances beyond the control of the seller/courier.

11.9. The goods are sent to the Buyer or the person specified by him at the exact address specified after receiving the payment, therefore the delivery term starts counting from the receipt of payment for the product(s), except when the circumstances provided for in Clause 6.4 of the Rules occur – in this case, the delivery term starts counting from the moment of contact with the Buyer days

11.10. The seller undertakes to make every effort to deliver the purchased item as soon as possible.

 

11.11. The seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of third parties or due to circumstances beyond the control of the Buyer.

11.12. The buyer, upon collecting or receiving the goods at the specified address, must together with the Seller or his authorized representative check the condition of the shipment and the item(s) and sign the invoice, waybill or other document of delivery and acceptance of the shipment. After the buyer signs the invoice, waybill or other document of transfer and acceptance of the shipment, it is considered that the shipment has been delivered in a suitable condition, and there are no damage to the goods, the basis of which cannot be attributed to a factory defect, as well as inconsistencies in the composition of the product(s) (such as can be determined by inspecting the goods outside) is not available. Upon noticing that the package of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the item(s) is damaged and/or the item(s) is not properly assembled, the Buyer must note this on the invoice, waybill or in another shipment transfer and acceptance document and, in the presence of the Seller or his representative, draw up a free-form shipment and/or product(s) violation (non-conformance) act.

11.13. The buyer fails to comply with p. 11.11 of the Rules. specified actions, the Seller is released from liability against the Buyer for damage to the goods, if the basis for such damage is not a factory defect, and for inconsistencies in the composition of the goods, if these inconsistencies can be determined by inspecting the outside of the goods.

11.14. The characteristics of all goods sold are indicated in the description attached to each item. The seller is not responsible for the fact that the color, shape, smell or other parameters of the goods in the electronic store may not correspond to the real size, shape, color of the goods, the Buyer’s imagination due to the characteristics of the monitor used by the Buyer, or the Buyer’s subjective assessment.

11.15. The risk of accidental loss or damage of the goods passes to the Buyer from the moment the goods are handed over to the Buyer.

 

  1. Return, exchange of goods

12.1. Goods purchased on Grozio.lt are returned and/or exchanged in accordance with Articles 6.362 and 6.363 of the Civil Code of the Republic of Lithuania, as well as the Government of the Republic of Lithuania of 2014. July 22 “Retail Trade Rules” approved by Resolution No. 738.

12.2. In order to return a quality product(s), the Buyer must notify the Seller in writing (e-mail) and fill out the product return form, which can be found in the Grozio.lt section “Return policy“. The Buyer can also submit the specified goods return form to the Seller together with the returned goods by registered mail. If the Buyer, when purchasing the product, used the opportunity to pick up the product at one of the “Grozio Galia” salons, he can personally deliver the returned product to the same salon, during the working hours of that salon.

12.3. The Buyer may exercise the right to return a high-quality and unused product within 14 (fourteen) working days from the day of delivery of the goods to him, informing the Seller about this in the manner provided for in Clause 12.2 of the Rules. 12.4. The following conditions are observed when returning goods:

12.4.1. The Buyer’s notification to the Seller about the return of the goods is submitted without missing the deadlines for the return of the goods;

12.4.2, the returned item must be in its original, neat packaging

12.4.3. the product must be undamaged by the Buyer;

12.4.4. the product must be unused (untested), without losing its merchandise appearance (label intact, protective film not torn off, etc.) (this clause does not apply in the case of returning a defective product);

12.4.5. the returned item must be in the same configuration as the one received by the Buyer;

12.4.6. any gifts that were included with the purchased item must be returned with the returned items.

12.4.7. when returning the product, it is necessary to present its purchase document and a completed return document;

12.4.8. the costs of purchasing and returning the goods shall be borne by the Buyer, except in cases where the goods are returned of poor quality – in such case, the costs of returning the goods shall be borne by the Seller;

12.4.9. money for returned goods is returned to the bank account specified by the Buyer.

12.5. If the Buyer on Grozio.lt purchased a set of goods completed by the Seller as one item, he must return the entire set of goods to the Seller, i.e. The buyer has the rights provided for the return of goods only in relation to all the goods in the set. In the event that the Buyer does not meet at least one of the conditions specified in clauses 12.4.1 – 12.4.7 in order to return the goods, the Seller has the right to refuse to accept the returned whole set of goods.

12.6. The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods have not been met.

12.7. If the Buyer has exercised the right enshrined in clause 5.3 of the Rules, the money shall be returned to him within 9 (nine) calendar days after the Seller has received the Buyer’s notification, and if the goods of the Buyer have not been returned to the Seller, the term stipulated in this clause shall be calculated from the day of the return of the goods to the Seller.

12.8. The Seller has the right not to return the amounts paid to the Buyer until the goods have been returned to the Seller and have not been checked for compliance with clauses 12.4.2 – 12.4.7 of the Rules.

12.9. If a price difference occurs when exchanging goods, the Buyer must settle with the Seller according to the recalculated prices.

 

  1. Exchange of information

13.1. The Seller sends messages to the Buyer using the contacts provided in the Buyer’s registration form – e-mail. e-mail address and/or phone number, and the Buyer, in order to contact the Seller, can use all communication channels specified in the “Contacts” section of the online store Grozio.lt.

 

  1. Liability

14.1. The buyer is fully responsible for the correctness of the data provided in the registration form. If the Buyer provides inaccurate data in the registration form, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation for the losses incurred from the Buyer.

14.2. The buyer is fully responsible for his actions performed on the electronic website, using Grozio.lt.

14.3. The buyer is responsible for the security and/or transmission of his registration data to third parties. In the event that a third party uses the Buyer’s registration data to connect to Grozio.lt and perform further related actions (for example, placing an order), the Seller considers such a person to be a Buyer.

14.4. The Seller is released from any responsibility in all cases where losses occur due to the fact that the Buyer, regardless of the Seller’s recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.

13.5. In the event of damage, the guilty party compensates the other party for direct losses.

 

  1. Marketing measures applied by the seller

15.1. The seller can carry out various types of promotions, and at any time unilaterally, without separate notice, change their terms and terminate them.

 

  1. Final Provisions

16.1. These Rules are drawn up in accordance with the legislation of the Republic of Lithuania and the European Union.

16.2. Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.

16.3. All disagreements arising from the implementation of the Rules are resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
